People are waiting for some body to go first and then they will take advantage of it and in between spread some rumour that the pay Band reduced, So that the left outs to get panic and money making business will start and collection will start throgh the new executive body but where will all the money to be deposited, The answer is obvious the old A/C which does not have any authencity with unelected treasurer at Mumbai. ReplyDelete"The Office Memorandum as issued by the Department of Expenditure, Ministry of Finance, Governing of India dated 30th August, 2008 for the implementation of the Sixth Pay Commission recommendations has inter alia appended the pay fixation fitment tables and the related instructions.
For the pre-revised pay scale of Rs. 8000-275-13500, the fitment tables have made two distinctions with two different pay bands as follows:
i. PB2 with revised pay band + grade pay of Rs. 9300 to34800 with a grade pay of Rs. 5400 and;
ii. PB3 with revised ay band + grade pay of Rs. 15600 to 39100 with a grade pay of Rs. 5400
As per the stated fitment table, the latter scale (PB3 as at ii above) is apparently applicable to personnel on direct Group A Entry only.( CAT Judgment is Implemented Notionally w.e.f. 1.1.1996 , So the 19th ,20th and 21st Barches of Education Officers have Enters As Group A Officers level in the CBWE)
The Head Office has mentioned pay Band 3 (15600-39100)+ GP 5400
But in Pay fixation Format sent by them and Using wrong Fitment Table of . PB2 with revised pay band + grade pay of Rs. 9300 to34800 with a grade pay of Rs. 5400
Infact, there is no need for fixation as the matter is pending in the court of law at Kolkatta.

DeleteIn DOPTt OM dated 31/3/1992 on the period of training spent before taking over charge of the post is counted as on duty and for drawal of increment. . So in our Case we are entitled for Increment from the Month when we Joined our Training at IIWE i.e. May 2004 for 21st Batch and December for 19th batch E.O. But in many Cases Wrong fixation is Done by CBWE HO Nagpur From the Date of Joining of E.O. at Regional Directorates

DeleteDear Friend is the above "MY" has any name or not. Pls write in details and specific. We have cocrete information that in the fixation sheet of some centres the PB is 15600 for all batches means babus doing and four jokers signing, it also raises question on the involvement of staff side along with no standard rule. If one yarsstick will be followed then how come a junior will drw more from a senior or persons of same batch will have difference in basic salary. Ridiculous still waiting , wait ... Wait... Wait... But friend if no protest note with in 45 days you are lost. The way it is fixed today like correction of bunching and base scale on 1996 has already done 4 years before to all the then RDs you can see a person was prviouly fixed as 8900 in pay scale of 6500 (EOSG 5th) but with CAT case his pay fixed at 10000 in pay scale of 10000(EOSG 5th post CAT) but people have accepted as they got more though with illogical fixation.

All cadre officers are already been given undertaking for excess payment will be deducted from their salary while they were taken arrears.it is natural justice of law, not end of justice.

ReplyDeleteObvious who so have drawn excess need to be recovered. But one question comes who will decide what is excess. Do we think a RD of 14th batch taking less salary than a EO of 15th batch is legal way of fixing. Friends you have not yet realised this dangerous trend of fixation. In 1962 there was single anamoly but the present fixation has resulted in 100s of new anamolies as well as court cases. Director and Chairman for few years but we are here till service or even like we people retired but pensioners for our life. Just think before becoming Parashar and discouraging wrong things. The best way is if our Admn. would have been wise they could have shout a legal or expert opinion by citing all facts not tampered fact like "UPGRADATION" "PROVISIONAL" which are no where in CAT order or in the order of Ministry as well as in letter of the then Director. All these mud sladging issues started because of our own experienced colleague Mr Reddy. Thats pathetic. First have facts and then write on BLOG.

ReplyDeleteAfter implementation of Sixth Pay Commission report there are various situations where an employee will be getting lesser pay than his junior. Normally, we can claim for removal of such pay anomaly as per procedures laid out.
However, in one of such situations employees may not be in a position to claim removal such anomaly. An option exercised under FR 22 (I) (a) (1) for postponement of increment may be a cause for receiving lesser pay than your juniors, when pay fixation procedures were changed on a later date by the Govt. This situation is explained below.
Two gentlemen A and B joined in Central Government Service in the same cadre on a same date during April 1994. Based on ranking in the selection examination & interview Officer B is junior to the Officer A. Till a particular period, both drew same salary and their increment month was April of every year. After implementation of 5th Pay Commission report with effect from 1996 by Government, they claimed to remove a pay anomaly as one of their juniors viz., Officer C, was drawing more pay than them. Since the said junior’s increment month was fixed in January he was getting more pay than Officer A and B. The claim of Officer A and B along with others who were sailing in the same boat were considered and their increment month was also advanced to January.
Afterwards, on 01.04.2004, the pay scale of the cadre in which Officer A and B are working was upgraded to the next pay scale. On account this up- gradation of Pay Scale, Officer A and B exercised their option for fixation of pay under FR 22 (I) (a) (1). Interestingly, this time, Officer A opted for pay fixation on the date of up-gradation (i.e.) on 01.04.04, and thereafter he started getting his annual increment in April. However, Officer B opted for pay fixation on the date of his next increment (i.e.) on 01.01.05 and he continued to get his annual increment in January.
Now, comes the implementation of Sixth Pay Commission report which paved the way for uniform annual increment in July for all employees. This causes fixation of lesser 6cpc revised pay for Officer A when compared to Officer B and C who are juniors to him. This is because Officer A is fixed with 6cpc revised pay on the basis of his pre-revised basic pay for which annual increment for the year 2006 was yet to be given as on 01.01.2006, as Officer A was due for his next increment only in April 2006.
From the above illustration, it could be understood that the change of increment month in respect of Officer A from January to April during 2004, is the cause for fixation of reduced revised pay to Officer A though he is senior to Officer B and Officer C. Whether this increment could be re-fixed to January as on 2004, for consequent higher pay benefits to Officer A ?
Mr.Rajasekar is of the view that as per the Office Memorandum No: 16/8/2002- Estt (Pay-I) dated 25.02.03, issued by DOPT, in the event of unanticipated developments or change of rules etc., the option exercised under FR 22 (I) (a) (1) by the Officer A for fixation of revised pay on 1.04.2004, consequent on his appointment in the higher grade on 1.4.2004, could be revised so that he in his revised option letter can opt for fixation of revised pay on the date of his original increment due in the year 2005 (i.e.) on 1.1.2005.
